In the event of a conflict between these Terms and a transaction-specific closing agreement, the closing agreement shall control.

Wire Fraud Warning & Security
Real estate wire fraud is a serious and growing threat. Criminals compromise email accounts of title companies, real estate agents, and lenders, then send fraudulent wiring instructions to divert closing funds. Carrillo Title Agency will never send wire transfer instructions solely via email, and we will never request last-minute changes to wiring information without verbal confirmation.
🚨 Critical — Read Before Wiring Any Funds: If you receive any email, text, or other communication that appears to be from Carrillo Title Agency containing wire transfer instructions or requesting a change to previously provided wire instructions, DO NOT WIRE FUNDS until you have called our office directly at a phone number you independently verified (not from the suspicious email). Always confirm wiring instructions by phone with a known team member before sending any funds.
Carrillo Title Agency is not liable for losses resulting from wire fraud where funds were transferred based on instructions provided by fraudulent third parties impersonating our firm, provided we have followed our standard security protocols. We strongly encourage all parties to independently verify wire instructions by phone before every wire transfer.
If you believe you have received a fraudulent communication purporting to be from Carrillo Title Agency, contact us immediately and report the incident to the FBI's Internet Crime Complaint Center (IC3) at ic3.gov.
Limitation of Liability
To the maximum extent permitted by applicable Florida law, Carrillo Title Agency, its members, managers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to:
- Your use of or inability to use our website or digital tools
- Reliance on any information, estimate, or content provided on our website
- Any errors, inaccuracies, or omissions in website content or calculator outputs

Claims arising from a specific title transaction are subject to the limitations set forth in the title commitment, title insurance policy, and applicable Florida law.
📋 Note: Some states do not allow the exclusion or limitation of certain damages. If you are located in a jurisdiction that restricts such limitations, the above limitations may not apply to you to the extent restricted by applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless Carrillo Title Agency, its members, managers, employees, agents, underwriters, and affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way connected with:
- Your use of our website or services in violation of these Terms
- Your violation of any applicable law or third-party rights
- False, inaccurate, or misleading information you provide to us
- Any fraudulent or unauthorized activity conducted through your account or on your behalf
- Your failure to verify wire transfer instructions before sending funds
Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Any legal action or proceeding arising under or relating to these Terms, your use of our website, or the services we provide shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida. You irrevocably consent to the personal jurisdiction and venue of such courts.
Carrillo Title Agency is licensed and regulated by the Florida Department of Financial Services and operates in compliance with applicable Florida title insurance statutes, including Chapter 627, Florida Statutes.
Dispute Resolution

You and Carrillo Title Agency agree that any dispute resolution proceedings, whether in arbitration or in court, will be conducted on an individual basis and not as part of a class or representative action. You waive any right to bring or participate in a class action related to your use of our website or services.
Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time in our sole discretion. When we make material changes, we will:
